§ 81-13-219 — Timing of entry of final decree of adoption of a minor child -- Posthumous adoption of a minor child.

(1)(1)(a) Except as provided in Subsection (1)(b) or (2), the court may not enter a final decree of adoption for a child adoptee until the earlier of:
(1)(a)(i) when the child adoptee has lived in the home of the prospective adoptive parent for 90 days; or
(1)(a)(ii) when the child adoptee has been placed for adoption with the prospective adoptive parent for 90 days.
(1)(b) Notwithstanding Subsection (1)(a), the court may enter a final decree of adoption at an earlier or later time than described in Subsection (1) if the court finds that there is good cause.
(2)(2)(a) If the prospective adoptive parent is the spouse of the pre-existing parent, the court may not enter a final decree of adoption for a child adoptee until the child adoptee has lived in the home of that prospective adoptive
