As used in this part:
(1)(1)(a) "Agency" means, except as provided in Subsection (1)(b), a state, county, or local government entity that generates or maintains records relating to a civil order for which expungement may be ordered.
(1)(b) "Agency" does not include the Division of Child and Family Services created in Section 80-2-201.
(2)"Civil order" means:
(2)(a) an ex parte civil protective order;
(2)(b) an ex parte civil stalking injunction;
(2)(c) a civil protective order; or
(2)(d) a civil stalking injunction.
(3)(3)(a) "Expunge" means to remove a record from public inspection by:
(3)(a)(i) sealing the record; or
(3)(a)(ii) restricting or denying access to the record.
(3)(b) "Expunge" does not include the destruction of a record.
