Text

(1)As used in this section:
(1)(a) "Government entity" means a town, city, county, metropolitan water district, or special district.
(1)(b) "Water facility" means any improvement or structure used, or intended to be used, to divert, convey, store, measure, or treat water.
(2)Except as provided in Subsection (3), a person may not acquire by adverse possession, prescriptive use, or acquiescence any right in or title to any real property:
(2)(a) held by a government entity; and
(2)(b) designated for any present or future public use, including:
(2)(b)(i) a street;
(2)(b)(ii) a lane;
(2)(b)(iii) an avenue;
(2)(b)(iv) an alley;
(2)(b)(v) a park;
(2)(b)(vi) a public square;
(2)(b)(vii) a water facility; or
(2)(b)(viii) a water conveyance right-of-way or water conveyance corridor.
