Text

(1)If a defendant enters a plea of guilty or no contest in conjunction with a plea in abeyance agreement, the court may hold the plea in abeyance:
(1)(a) in accordance with Chapter 2a, Pleas in Abeyance; and
(1)(b) under the terms of the plea in abeyance agreement.
(2)If a defendant is convicted, the court:
(2)(a) shall impose a sentence in accordance with Section 76-3-201; and
(2)(b) subject to Subsection (5), may suspend the execution of the sentence and place the defendant:
(2)(b)(i) on probation under the supervision of the division;
(2)(b)(ii) on probation under the supervision of an agency of a local government or a private organization; or
(2)(b)(iii) on court probation under the jurisdiction of the sentencing court.
