Text

As used in this part:

(1)(1)(a) "Individual with a severe intellectual disability" means an adult who:
(1)(a)(i) has lifelong functional limitations to the extent that the adult is incapacitated; and
(1)(a)(ii) has received a diagnosis from a physician or psychologist of a severe intellectual disability that has existed since the adult was a minor.
(1)(b) "Individual with a severe intellectual disability" does not include an adult who had capacity at one time or may regain capacity.
(2)"Petitioner" means the person who brings a petition for guardianship under this part.
(3)"Physician" means an individual:
(3)(a) licensed as a physician under Title 58, Chapter 67, Utah Medical Practice Act; or
(3)(b) licensed as a physician under Title 58, Chapter 68, Utah Osteopathic Medical Practice Ac
