Text
(1)The point of discharge of water from a POTW may be changed if the director determines that a change is necessary:
(1)(a) for treatment purposes;
(1)(b) to enhance environmental quality;
(1)(c) to protect public health, safety, or welfare; or
(1)(d) to comply with:
(1)(d)(i) rules created by the Water Quality Board in accordance with Section 19-5-104; or
(1)(d)(ii) the POTW's discharge permit.
(2)Before changing the point of discharge from a POTW under Subsection (1), the director shall consult with the state engineer.
