Text
(1)(1)(a) Upon written request, the state engineer shall segregate into two or more parts the following in the state engineer's records:
(1)(a)(i) an application to:
(1)(a)(i)(A) under Section 73-3-2, appropriate water;
(1)(a)(i)(B) under Section 73-3-3, permanently change:
(1)(a)(i)(B)(I) the point of diversion;
(1)(a)(i)(B)(II) the place of water use; or
(1)(a)(i)(B)(III) the purpose of water use; and
(1)(a)(ii) a water right for which:
(1)(a)(ii)(A) the state engineer has issued a certificate according to Section 73-3-17;
(1)(a)(ii)(B) a court has entered a judgment according to Section 73-4-15; and
(1)(a)(ii)(C) a person has filed a claim according to Section 73-5-13.
(1)(b) A person shall:
(1)(b)(i) submit the request authorized by Subsection (1)(a) on a form furnished by the state e
