Text

(1)As used in this section:
(1)(a) "Public water supplier" is as defined in Section 73-1-4.
(1)(b) "Wholesale electrical cooperative" is as defined in Section 54-2-1.
(2)(2)(a) Within the time set by the state engineer under Subsection 73-3-10(5), an applicant shall:
(2)(a)(i) construct works, if necessary;
(2)(a)(ii) apply the water to beneficial use; and
(2)(a)(iii) file proof with the state engineer in accordance with Section 73-3-16.
(2)(b) Except as provided by Subsection (4), the state engineer shall extend the time in which an applicant shall comply with Subsection (2)(a) if:
(2)(b)(i) the date set by the state engineer is not after 50 years from the day on which the application is approved; and
(2)(b)(ii) the applicant shows:
(2)(b)(ii)(A) reasonable and due diligence in comple
