§ 73-10g-604 — State council's general duties related to prioritizing -- Reporting -- Relevant agency actions.

(1) The state council shall:
(1)(a) beginning with fiscal year 2027, determine priorities and funding levels of water infrastructure projects for each fiscal year based on the water infrastructure projects ranked by relevant agencies under Section 73-10g-603;
(1)(b) hold public meetings in accordance with Title 52, Chapter 4, Open and Public Meetings Act, and otherwise provide for public input on funding of water infrastructure projects; and
(1)(c) make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, necessary to perform the state council's duties related to:
(1)(c)(i) adopting the unified water infrastructure plan;
(1)(c)(ii) adopting a written prioritization process; and
(1)(c)(iii) prioritizing and setting funding levels for water infrastructure projects.
(2) (2)(a) For water infrastructure projects prioritized with funding provided under this title, the state council shall annually report, by no later than the October interim meeting of the Legislature, to the Legislative Water Development Commission:
(2)(a)(i) a prioritized list of the water infrastructure projects and the funding levels available for those water infrastructure projects; and
(2)(a)(ii) the unfunded water infrastructure projects and maintenance needs within the state.
(2)(b) The Legislative Water Development Commission shall:
(2)(b)(i) review the prioritized list reported by the state council; and
(2)(b)(ii) recommend to the Legislature:
(2)(b)(ii)(A) the amount of additional funding to allocate to water infrastructure projects; and
(2)(b)(ii)(B) the source of revenue for the additional funding allocation under Subsection (2)(b)(ii)(A).
(3) A relevant agency shall administer money prioritized under this part in a manner consistent with this part.
