(1)There is established a grant program known as the Broadband Equity Access and Deployment Grant Program that is administered by the broadband center in accordance with:

(1)(a) this part; and

(1)(b) the requirements of the National Telecommunications and Information Administration's Broadband Equity Access and Deployment Program, 47 U.S.C. Sec. 1702 et seq.

(2)The broadband center shall:

(2)(a) prepare and submit the state's Broadband Equity Access and Deployment application, including the letter of intent, initial proposal, and final proposal to the National Telecommunications and Information Administration;

(2)(b) administer the Broadband Equity Access and Deployment Grant Program in accordance with this section and as approved by the National Telecommunications and Information Admini

(3) The department, in coordination with the broadband center, may make rules in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, to administer the grant program.
(4) The broadband center may approve an application for subgranted funds if:
(4)(a) the application meets the requirements of this section;
(4)(b) the application meets any rule made pursuant to this section;
(4)(c) the application meets the requirements of the National Telecommunications and Information Administration's Broadband Equity Access and Deployment Program, 47 U.S.C. Sec. 1702 et seq.; and
(4)(d) the broadband center has informed the Transportation Commission about the application described in Subsection (2)(c).
(5) After the broadband center completes a competitive application process for subgranted funds but before the broadband center notifies the applicant of the award, the broadband center shall present to the Transportation Commission on the subgrant award.
