Text

(1)A procurement unit may award a trial use contract without engaging in a standard procurement process if:
(1)(a) the purpose of the contract is to:
(1)(a)(i) determine whether the procurement item will benefit the procurement unit;
(1)(a)(ii) assess the feasibility of a procurement item that:
(1)(a)(ii)(A) is new or innovative; or
(1)(a)(ii)(B) has a proposed use or application that is novel or unproven; or
(1)(a)(iii) evaluate whether to conduct a standard procurement process for the procurement item being tested; and
(1)(b) the contract is:
(1)(b)(i) awarded for a procurement item that is not already available to the procurement unit under an existing contract;
(1)(b)(ii) restricted to the procurement of a procurement item in the minimum quantity and for the minimum period of time n
