(1)(1)(a) A records appellant appeals to the director by filing a notice of appeal with the director no later than 30 days after the day on which the decision being appealed is issued.
(1)(b) Notwithstanding Subsection (1)(a), a requester may file a notice of appeal with the director no later than 45 days after the day on which the record request is made if:
(1)(b)(i) the circumstances described in Subsection 63G-2-401(1)(b) occur; and
(1)(b)(ii) the chief administrative officer fails to make a decision under Section 63G-2-401.
(1)(c) The time for a requester to file a notice of appeal under Subsection (1)(a) or (b) is suspended for the period of time that:
(1)(c)(i) begins on the date the requester submits a request under Section 63A-12-204 for the government records ombudsman to mediate
