Text

(1)As used in this section:
(1)(a) "Qualified individual" means an individual who:
(1)(a)(i) is employed by an LEA; and
(1)(a)(ii) provides related services in a school-based setting.
(1)(b) "Qualified individual" includes:
(1)(b)(i) an audiologist;
(1)(b)(ii) a speech-language pathologist;
(1)(b)(iii) a mental health practitioner;
(1)(b)(iv) a school nurse;
(1)(b)(v) an occupational therapist; and
(1)(b)(vi) a physical therapist.
(1)(c) "Related services" means the same as that term is defined in 34 C.F.R. 300.34.
(2)An LEA may adopt a salary schedule, or salary schedules, for qualified individuals, that:
(2)(a) is separate from salary schedules adopted for other LEA employees; and
(2)(b) takes into consideration the market rate for related services provided outside of a school-based
