(1)There is created the Public Health and Economic Emergency Commission consisting of the following members:
(1)(a) the executive director of the Department of Health, or the executive director's designee;
(1)(b) four individuals, appointed by the governor, including:
(1)(b)(i) the chief executive of a for profit health care organization that operates at least one hospital in the state;
(1)(b)(ii) the chief executive of a not-for-profit health care organization that operates at least one hospital in the state; and
(1)(b)(iii) two other individuals;
(1)(c) two individuals appointed by the president of the Senate;
(1)(d) two individuals appointed by the speaker of the House of Representatives; and
(1)(e) one individual appointed by the chief executive officer of the Utah Association of Cou

(1) There is created the Public Health and Economic Emergency Commission consisting of the following members:

(1)(b) four individuals, appointed by the governor, including:

(2) (2)(a) The president of the Senate and the speaker of the House of Representatives shall jointly designate one of the members appointed under Subsection (1)(c) or (d) as chair of the commission.
(2)(b) For an appointment under Subsection (1)(c) or (d), the president of the Senate or the speaker of the House of Representatives may appoint a legislator or a non-legislator.
(3) (3)(a) If a vacancy occurs in the membership of the commission appointed under Subsection (1)(b), (c), (d), or (e), the member shall be replaced in the same manner in which the original appointment was made.
(3)(b) A member of the commission serves until the member's successor is appointed and qualified.
(4) (4)(a) A majority of the commission members constitutes a quorum.
(4)(b) The action of a majority of a quorum constitutes an action of the commission.
(5) (5)(a) The salary and expenses of a commission member who is a legislator shall be paid in accordance with Section 36-2-2, Legislative Joint Rules, Title 5, Chapter 2, Lodging, Meal, and Transportation Expenses, and Legislative Joint Rules, Title 5, Chapter 3, Legislator Compensation.
(5)(b) A commission member who is not a legislator may not receive compensation or benefits for the member's service on the commission, but may receive per diem and reimbursement for travel expenses incurred as a commission member at the rates established by the Division of Finance under:
(5)(b)(i) Sections 63A-3-106 and 63A-3-107; and
(5)(b)(ii) rules made by the Division of Finance pursuant to Sections 63A-3-106 and 63A-3-107.
(6) The Governor's Office of Planning and Budget shall:
(6)(a) provide staff support to the commission; and
(6)(b) coordinate with the Office of Legislative Research and General Counsel regarding the commission.
(7) A meeting of the commission that takes place during a public health emergency is not subject to Title 52, Chapter 4, Open and Public Meetings Act.
