§ 51-7-24 — Sales and purchase in violation -- Remedies -- Limitation of action.

(1)(1)(a) Each certified investment adviser or certified dealer who transacts securities business with a public treasurer in violation of this chapter or any rule made or order issued under authority of this chapter is liable to the public treasurer.
(1)(b) The public treasurer may either sue to recover either:
(1)(b)(i) damages, if the public treasurer no longer owns the security; or
(1)(b)(ii) the sum of the following, less the amount of any income received on the security upon the tender of the security:
(1)(b)(ii)(A) the consideration paid for the security;
(1)(b)(ii)(B) interest at 12% per year from the date of payment;
(1)(b)(ii)(C) costs; and
(1)(b)(ii)(D) reasonable attorney's fees.
