Text
(1)Subsection (2) applies if the board determines that an operator has neglected, failed, or refused to:
(1)(a) plug and abandon a brine well;
(1)(b) close any surface impoundment;
(1)(c) repair a brine well leaking or causing waste; or
(1)(d) maintain and reclaim a site.
(2)A person who violates Subsection (1) shall forfeit from the person's surety or shall pay to this state a sum equal to the cost of:
(2)(a) plugging a brine well;
(2)(b) closure of the surface impoundment;
(2)(c) repair of the brine well leaking or causing waste; or
(2)(d) reclamation of the site.
