§ 34A-2-403 — Dependents -- Presumption.

(1)(1)(a) The following persons are presumed to be wholly dependent for support upon a deceased employee:
(1)(a)(i) a child under 18 years of age, subject to the conditions of Subsections (1)(b) and (2)(b);
(1)(a)(ii) a child who is 18 years of age or older:
(1)(a)(ii)(A) if the child is:
(1)(a)(ii)(A)(I) physically or mentally incapacitated; and
(1)(a)(ii)(A)(II) dependent upon the parent who is the deceased employee; and
(1)(a)(ii)(B) subject to the conditions of Subsections (1)(b) and (2)(b); and
(1)(a)(iii) for purposes of a payment to be made under Subsection 34A-2-702(5)(b)(i), a surviving spouse with whom the deceased employee lived at the time of the employee's death.
(1)(b) Subsections (1)(a)(i) and (ii) require that:
(1)(b)(i) the deceased employee be the parent of the child; o
