§ 31A-31-108 — Assessment of insurers.

Utah·Title 31A Insurance Code·Ch. 31A-31 Insurance Fraud Act
(1)For purposes of this section:
(1)(a) The commissioner shall by rule made in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act, define:
(1)(a)(i) "annuity consideration";
(1)(a)(ii) "membership fees";
(1)(a)(iii) "other fees";
(1)(a)(iv) "deposit-type contract funds"; and
(1)(a)(v) "other considerations in Utah."
(1)(b) "Insurance fraud provisions" means:
(1)(b)(i) this chapter;
(1)(b)(ii) Section 34A-2-110; and
(1)(b)(iii) Section 76-6-521.
(1)(c) "Utah consideration" means:
(1)(c)(i) the total premiums written for Utah risks;
(1)(c)(ii) annuity consideration;
(1)(c)(iii) membership fees collected by the insurer;
(1)(c)(iv) other fees collected by the insurer;
(1)(c)(v) deposit-type contract funds; and
(1)(c)(vi) other considerations in Utah.
