§ 31A-17-603 — Company action level event.

Utah·Title 31A Insurance Code·Ch. 31A-17 Determination of Financial Condition·Part 31A-17-6 Risk-Based Capital
(1)"Company action level event" means any of the following events:
(1)(a) the filing of an RBC report by an insurer or health organization that indicates that:
(1)(a)(i) the insurer's or health organization's total adjusted capital is greater than or equal to its regulatory action level RBC but less than its company action level RBC;
(1)(a)(ii) if a life insurer, accident and health insurer, or health organization, the insurer or health organization:
(1)(a)(ii)(A) has total adjusted capital that is greater than or equal to its company action level RBC but less than the product of its authorized control level RBC and 3.0; and
(1)(a)(ii)(B) triggers the trend test determined in accordance with the trend test calculation included in the life, fraternal, or health RBC instructions; or
