§ 26B-5-381 — Contracted state hospital services.

(1) In accordance with the authority, responsibilities, and duties granted to the division and state hospital under this part, the state hospital may contract with any willing provider to:
(1)(a) supervise and treat a patient with a mental illness who has been committed to the state hospital's custody; or
(1)(b) facilitate the reentry of a discharged patient into the community.
(2) A provider who enters into a contract with the state hospital under Subsection (1) shall provide a level of supervision and security that is equal to or greater than the level of supervision and security that:
(2)(a) is necessary to treat the patient with a mental illness; and
(2)(b) would be offered at or recommended by the state hospital.
(3) In collaboration with the Division of Integrated Healthcare, the superintendent and clinical director shall provide a report to the Health and Human Services Interim Committee at or before the committee's 2024 November interim meeting that includes information and recommendations on:
(3)(a) the number of patients with a mental illness served through a state hospital contract in accordance with Subsection (1), and the nature of the services rendered;
(3)(b) addressing the needs of patients with complex legal and mental health statuses who are expected to have significantly long stays at the state hospital and who are not able to be discharged into the community;
(3)(c) the creation of a low-acuity step-down facility to assist patients described in Subsection (3)(b); and
(3)(d) opportunities for collaboration with local mental health authorities and other willing providers to provide low-acuity step-down services to assist patients described in Subsection (3)(b).
