(1)(1)(a) This section applies to the Medicaid program and to the Utah Children's Health Insurance Program created in Section 26B-3-902.
(1)(b) As used in this section:
(1)(b)(i) "Managed care organization" means a comprehensive full risk managed care delivery system that contracts with the Medicaid program or the Children's Health Insurance Program to deliver health care through a managed care plan.
(1)(b)(ii) "Managed care plan" means a risk-based delivery service model authorized by Section 26B-3-202 and administered by a managed care organization.
(1)(b)(iii) "Non-emergent care":
(1)(b)(iii)(A) means use of the emergency department to receive health care that is non-emergent as defined by the department by administrative rule adopted in accordance with Title 63G, Chapter 3, Utah Admi
