Text
(1)A congregate care program may not take any adverse action against a child or any other individual for:
(1)(a) communicating with the ombudsman;
(1)(b) cooperating with the ombudsman; or
(1)(c) facilitating the ombudsman in performing the ombudsman's duties under Section 26B-2-124.2.
(2)An adverse action under Subsection (1) includes:
(2)(a) a termination;
(2)(b) a demotion;
(2)(c) a suspension;
(2)(d) a reduction in hours;
(2)(e) harassment;
(2)(f) intimidation;
(2)(g) creating a hostile work environment;
(2)(h) threatening to report an employee to licensing agencies or law enforcement without cause;
(2)(i) a reduction in pay, benefits, or access to opportunities; or
(2)(j) any other action that would deter a reasonable employee from performing any action described in Subsection (1).
