Text

(1)There is created an expendable special revenue fund known as the "Licensed Provider Civil Money Penalty Fund" consisting of:
(1)(a) federal civil money penalty funds received under the federal Centers for Medicare and Medicaid Facility Licensing and Inspection Act, including any existing funds previously received and allocable to the Division of Licensing and Background Checks;
(1)(b) money appropriated or otherwise made available by the Legislature; and
(1)(c) any interest earned on the fund.
(2)Money in the fund may only be used by the department under a federally approved state plan:
(2)(a) to assist individuals effected by a shutdown of a facility or program under this title;
(2)(b) for administrative expenses; or
(2)(c) for allowable activities.
