Text

(1)A person is guilty of an unlawful act if the actor:
(1)(a) fails to take an action required by Section 23A-4-501; or
(1)(b) takes an action prohibited by Section 23A-4-501.
(2)(2)(a) Except as provided in Subsections (2)(b) and (c), a violation of Subsection (1) is a class B misdemeanor.
(2)(b) A violation of Subsection (1) is a class A misdemeanor if the aggregate amount required under Subsection 23A-4-501(5)(a):
(2)(b)(i) is at least $1,000, but less than $10,000;
(2)(b)(ii) is not submitted for one or more months; and
(2)(b)(iii) remains uncollectable.
(2)(c) A violation of Subsection (1) is a felony of the third degree if the aggregate amount required under Subsection 23A-4-501(5)(a):
(2)(c)(i) is $10,000 or more;
(2)(c)(ii) is not submitted for one or more months; and
(2)(c)(iii
