§ 23A-13-303 — Nuisances.

(1)(1)(a) A county shall exclude the activities described in Subsection (1)(b) from the definition of public nuisance in a county law or ordinance regulating a public nuisance.
(1)(b) An activity or occurrence normally associated with a migratory bird production area is not a nuisance, including:
(1)(b)(i) hunting;
(1)(b)(ii) discharging a firearm;
(1)(b)(iii) improving habitat;
(1)(b)(iv) trapping;
(1)(b)(v) eradicating weeds;
(1)(b)(vi) discing;
(1)(b)(vii) planting;
(1)(b)(viii) impounding water;
(1)(b)(ix) raising a bird or other domestic animal;
(1)(b)(x) grazing;
(1)(b)(xi) an activity conducted in the normal course of an agricultural operation as defined in Section 4-44-102; and
(1)(b)(xii) an odor.
