§ 19-2-109.7 — Permit by rule registration expansion study.

(1) As used in this section:
(1)(a) "Permit by rule" means a permitting or registration process in which a stationary source submits a written registration notice to the director to exempt the stationary source from the requirement to obtain an approval order.
(1)(b) "Permit by rule" includes a permitting or registration process designed to exempt a category of similar stationary sources from the requirement to obtain an approval order.
(2) The division shall conduct a study on the feasibility of expanding the division's permit by rule program by:
(2)(a) reviewing successful permit by rule programs in other states;
(2)(b) identifying potential categories of sources suitable for inclusion in the permit by rule program, including:
(2)(b)(i) abrasive cleaning;
(2)(b)(ii) aggregate processing;
(2)(b)(iii) asphalt plants;
(2)(b)(iv) auto body refinishing shops;
(2)(b)(v) boilers and combustion devices;
(2)(b)(vi) concrete batch plants;
(2)(b)(vii) crushing and screening operations;
(2)(b)(viii) degreasing operations;
(2)(b)(ix) dry cleaning;
(2)(b)(x) dust control;
(2)(b)(xi) emergency generators, pumps, and compressors;
(2)(b)(xii) fuel dispensing;
(2)(b)(xiii) internal combustion engines;
(2)(b)(xiv) mineral processing;
(2)(b)(xv) natural gas-fired boilers and heaters;
(2)(b)(xvi) printing operations;
(2)(b)(xvii) sand and gravel operations;
(2)(b)(xviii) surface coating;
(2)(b)(xix) landfills; and
(2)(b)(xx) wood processing; and
(2)(c) assessing the environmental and economic impacts of expanding the program.
(3) On or before November 30, 2025, the division shall:
(3)(a) make rules to include at least five categories of sources listed in Subsection (2)(b) in the division's permit by rule program in accordance with Title 63G, Chapter 3, Utah Administrative Rulemaking Act; and
(3)(b) report to the Natural Resources, Agriculture, and Environment Interim Committee:
(3)(b)(i) the division's recommendations for expanding the permit by rule program, including:
(3)(b)(i)(A) the addition of new categories of sources, if any, to the program; and
(3)(b)(i)(B) changes to statute or rules necessary to implement the program; and
(3)(b)(ii) the estimated impacts of expanding the permit by rule program on:
(3)(b)(ii)(A) air quality;
(3)(b)(ii)(B) permitting efficiency; and
(3)(b)(ii)(C) regulated sources.
