§ 17-81-603 — Criteria considered in adopting the geographic area of a county large concentrated animal feeding operation land use ordinance -- Maps -- Exception.

(1)(1)(a) To determine the geographic areas where large concentrated animal feeding operations may be located under a county large concentrated animal feeding operation land use ordinance, the county shall consider:
(1)(a)(i) the distance of the geographic area measured in feet from the following:
(1)(a)(i)(A) a residential zone;
(1)(a)(i)(B) a health care facility;
(1)(a)(i)(C) a public area;
(1)(a)(i)(D) an education institution;
(1)(a)(i)(E) a religious institution;
(1)(a)(i)(F) a commercial enterprise;
(1)(a)(i)(G) a municipal boundary; and
(1)(a)(i)(H) a state or county highway or road;
(1)(a)(ii) prevailing winds;
(1)(a)(iii) topography;
(1)(a)(iv) economic benefits to the county; and
(1)(a)(v) reasonable access to transportation, water, and power infrastructure.
