§ 17-79-802 — Urban development in municipal expansion area -- Requirements.

(1)For purposes of this section, "urban development" means the same as that term is defined in Section 10-2-801.

(2)A county legislative body may approve urban development within an adopted expansion area of a municipality if the county notifies the municipality of the proposed urban development, and:

(2)(a) the municipality consents in writing to the proposed urban development; or

(2)(b) the municipality fails to respond to the county's notification of the proposed urban development within 90 days after the day on which the county provides the notice.

(3)If a municipality responds to the county's notice under Subsection (2) within 90 days after the county's notification of the proposed urban development to object to the proposed urban development, the county may approve the urban devel
