Text

(1)The division may bring an action in a court with jurisdiction to:
(1)(a) obtain a declaratory judgment that an act or practice violates this chapter;
(1)(b) enjoin, in accordance with the principles of equity, a supplier that has violated, is violating, or is otherwise likely to violate this chapter;
(1)(c) order disgorgement of money or any thing of value received in violation of this chapter;
(1)(d) recover, for each violation, restitution for actual damages, or obtain relief under Subsection (2)(b), on behalf of impacted consumers; and
(1)(e) obtain a fine in an amount determined after considering the factors in Subsection (6).
(2)(2)(a) The division may bring a class action on behalf of consumers for the actual damages caused by an act or practice specified as violating this chapt
