Sec. 59.053. WAIVER OF INFRASTRUCTURE REQUIREMENTS.

(a)For an electing company that serves fewer than one million lines, the commission may waive a requirement prescribed by Section 59.052 if the company demonstrates that the investment is not viable economically.
(b)Before granting a waiver under Subsection (a), the commission must consider the public benefits that would result from compliance with the requirement.
