Sec. 366.164. RIGHT OF ENTRY.

(a)To acquire property necessary or useful in connection with a turnpike project, an authority may enter any real property, water, or premises to make a survey, geotechnical evaluation, sounding, or examination.
(b)An entry under Subsection (a) is not:
(1)a trespass; or
(2)an entry under a pending condemnation proceeding.
(c)The authority shall make reimbursements for any actual damages to real property, water, or premises that result from an activity described by Subsection (a).
