Sec. 201.604. ENVIRONMENTAL REVIEW.

(a)The commission by rule shall provide for the commission's environmental review of the department's transportation projects that are not subject to review under the National Environmental Policy Act (42 U.S.C. Section 4321 et seq.). The rules must provide for:
(1)public comment on the department's environmental reviews, including the types of projects for which public hearings are required, and a procedure for requesting a public hearing on an environmental review for which a public hearing is not required;
(2)the department's evaluation of direct and indirect effects of its projects;
(3)analysis of project alternatives; and
(4)a written report that briefly explains the department's decision on a project and that specifies the mitigation measures
