Sec. 2051.451. ADMINISTRATIVE PENALTY.

(a)If the secretary of state determines that a person regulated under this chapter has violated this chapter or a rule adopted under this chapter in a manner that constitutes a ground for disciplinary action under Section 2051.405 , the secretary may assess an administrative penalty against the person as provided by this subchapter.
(b)The secretary shall determine the amount of a penalty assessed under Subsection (a), except that the amount may not exceed:
(1)$50,000 for a violation of Section 2051.351 (a)(7) or (14); or
(2)$25,000 for any other violation.
(c)In determining the amount of a penalty under Subsection (b), the secretary shall consider the seriousness of the violation.
