Sec. 401.387. CONSENT TO PENALTY.

(a)If the person charged with the violation consents to the penalty recommended by the department or does not respond to the notice on time, the department by order shall assess that penalty or order a hearing to be held on the findings and recommendations in the report.
(b)If the department assesses the recommended penalty, the department shall give written notice to the person charged of the decision and that person must pay the penalty.
