Sec. 499.101. MAXIMUM CAPACITIES.

(a)The board by rule shall establish maximum capacities for the units in the department.
(b)It is the intent of the legislature that as case law evolves and indicates that maximum capacities for units in the department may be increased, the staff of the department shall use the procedures established by this subchapter to increase those capacities. There shall be no cause of action against the institutional division for failure to take action under this subsection.
