Sec. 107.114. INTRODUCTION AND PROVISION OF CHILD CUSTODY EVALUATION REPORT.

(a)Disclosure to the court or the jury of the contents of a child custody evaluation report prepared under Section 107.113 is subject to the rules of evidence. (a-1) Unless the child custody evaluator is appointed under Section 107.106, the court may not admit into evidence a child custody evaluation report prepared under Section 107.113 if:
(1)the child who is the subject of the report has an intellectual disability or developmental disability; and
(2)on the date the evaluation that is the subject of the report was made, the child custody evaluator had not satisfied the training requirement under Section 107.104(f).
