Sec. 45.109. CONTRACTS FOR ATHLETIC FACILITIES.

(a)Any independent school district, acting by and through its board of trustees, may contract with any corporation, municipality, or institution of higher education, as defined by Section 61.003 , located wholly or partially in its boundaries, for the use of any stadium and other athletic facilities owned by or under the control of the other entity. The contract may be for any period not exceeding 75 years and may contain terms agreed on by the parties. (a-1) An independent school district and an institution of higher education, as defined by Section 61.003 , located wholly or partially in the boundaries of the county in which the district is located may contract for the district to contribute district resources to pay a portion of the costs
