Sec. 171.097. TRANSFER.

(a)On application of a party adverse to the party who filed the initial application, a court that has jurisdiction but that is not a court described by Section 171.096 shall transfer the application to a court described by that section.
(b)The court shall transfer the application by an order comparable to an order sustaining a plea of privilege to be sued in a civil action in a district court or a division of the business court of a county other than the county in which an action is filed.
(c)The party must file the application under this section:
(1)not later than the 20th day after the date of service of process on the adverse party; and
(2)before any other appearance in the court by that adverse party, other than an appearance to challenge the jurisdiction o
