Sec. 39.009. COMPLIANCE WITH CERTAIN CHAPTER REQUIREMENTS; LEGISLATIVE OVERSIGHT.

(a)Failure to comply with a requirement of Subchapter B, C, or D:
(1)does not prevent:
(A)the administration of a statewide assessment instrument required under Subchapter B; or
(B)the assignment of performance ratings under Section 39.054 ; and
(2)may not be the basis of a challenge to:
(A)a performance rating assigned under Section 39.054 ; or
(B)an intervention or sanction imposed under this chapter or Chapter 39A .
(b)Each standing legislative committee with primary jurisdiction over primary and secondary education shall establish a process to receive information regarding a failure to comply with a requirement of Subchapter B, C, or D and may require the agency to provide justification for that f
