§ 69-11-124 — Duties and liabilities of owners - Right of action against owners - Duties and liabilities of state counties or cities

(a) Nothing in this chapter shall be construed to relieve the owner or owners of a dam or reservoir of the legal duties, obligations, or liabilities incident to the ownership or operation of the dam or reservoir. (b) Nothing in this chapter shall abrogate the right of any person who is materially or personally damaged or injured by the operation of a dam or reservoir to seek remedies against the responsible person in the courts. (c) Nothing in this chapter shall be construed to impose legal duties, obligations or liabilities incident to the ownership or operation of a dam upon the state, a county or city that maintains a roadway upon a dam if the state, such county or city did not construct the dam. The repair and maintenance of such roadway shall be the sole responsibility of the state or the county or city constructing the roadway.
