Text

With regard to a healthcare facility that has been the subject of a change of control as defined by regulation, the health facilities commission may issue a new license to the successor owner. The use of this authority is limited to circumstances where:

(1)The successor owner meets the qualifications for a license;
(2)The healthcare facility has no outstanding license or certification deficiencies; and (3) The successor owner already owns or controls at least one (1) other healthcare facility in this state.
