(a)(1) Every application for a driver license, instruction permit, intermediate driver license, and photo identification card shall be made upon a form furnished by the department. Every application shall be accompanied by a birth certificate or other proof of the applicant's date of birth that is satisfactory to the driver license examiner and by a nonrefundable fee of two dollars ($2.00), which shall constitute expendable receipts of the department. The application shall also be accompanied by proof of Tennessee residency acceptable to the department.
(2)The application fee required under subdivision (a)(1) is not required in the case of applications for restricted driver licenses under § 40-24-105(b) .
(b)The driver license examiner is authorized and required to obtain positive proof
