Text

(a)As used in this section, "eligible operator" means:
(1)A person who owns and operates a freight motor vehicle registered pursuant to § 55-4-113(a)(2)(E)-
(K); or (2) A person who operates a freight motor vehicle registered pursuant to § 55-4-113(a)(2)(E)-
(K)and who owns fifty-one percent (51%) or more of the stock in the entity that owns the freight motor vehicle.
(b)Upon the death of an eligible operator, in order to secure a refund of the unused portion of the registration fee paid, the certificate of registration and related license plate must be surrendered to, and a copy of the death certificate of the deceased eligible operator must be submitted to, the department.
