(a)(1) If the commission, upon review and consideration of an application for institutional authorization, program registration, or other application, determines that the applicant fails to meet the criteria established as provided in this part or as provided in the rules promulgated pursuant to this part, then the commission shall notify the applicant, provide, in writing, the reasons for which the applicant failed to meet the criteria, and defer or deny the application.
(2)The commission may grant an applicant an extension of time, of reasonable duration, in which the applicant may eliminate the reasons for deferral contained in the statement of deferral, if the applicant has demonstrated, to the satisfaction of the commission, the applicant's desire to meet the requirements of this pa
