In the event that any bidder fails to execute the contract and bond as required under this part, in the event any contractor fails to carry out the contract, in the event all bids are unsatisfactory or in the event of the invalidation of any adoption, the state textbook and instructional materials quality commission is specifically authorized to proceed at once to make such rules and regulations concerning the filing of bids and samples as are necessary for an immediate listing for adoption in the subjects for which no adoption exists. The commission shall then proceed to make recommendations of books for adoption to the state board of education, after which the state board shall select and list certain books for adoption.
