§ 58-18B-2 — Chapter applicable to small employer benefit plans.

South Dakota·Title 58 INSURANCE·Ch. 58-18B REGULATION OF SMALL BUSINESSES' GROUP AND BLANKET HEALTH INSURANCE

This chapter is applicable to any health benefit plan which provides coverage to two or more employees of a small employer and policies which meet the following criteria:

(1)Any portion of the premium or benefits is paid by or on behalf of the small employer; or (2) The health benefit plan is treated by the employer or any of the eligible employees or dependents as part of a plan or program for the purposes of section 125 or section 106 of the United States Internal Revenue Code as of January 1, 1995. This chapter does not apply to any employer plan with only one employee. Any employer plan with only one employee, even if the employer pays a portion or all of the premium, may be sold as individual policies subject to the provisions of chapter 58-17 .
