After July 1, 2004, a company may elect to apply its provisions to annuity contracts on a contract form - by - contract form basis before the second anniversary of the effective date of §§ 58-15-83 to , inclusive. In all other instances, §§ 58-15-83 to , inclusive, shall become operative with respect to annuity contracts issued by the company after the second anniversary of the effective date of §§ 58-15-83 to , inclusive.
