§ 46A-10A-68 — Damages due to project--Determination--Hearing--Appeal.

South Dakota·Title 46A WATER MANAGEMENT·Ch. 46A-10 COUNTY DRAINAGE
If a board establishes a project pursuant to § 46A-10A-65 , it shall calculate the damage sustained by each tract of land or by other property due to construction or maintenance of the project. The board shall give notice of its determination of damages to the respective landowners and shall schedule a hearing thereon. Damages to crops growing during construction may be calculated at a later time and shall be considered part of the cost of construction. At the hearing, the board will receive evidence on the question of damages and just compensation. Any affected person or competent witness on his behalf may testify in the matter of damages or compensation for land.
