Civil penalties specified in §§ 38-21-15.2 , 38-21-17 , 38-21-23 , 38-21-33.1 , 38-21-39.1 , 38-21-39.2 , 38-21-39.3 , 38-21-40 , and 38-21-44 do not lessen the damages that may be awarded to any person injured.
