The board may, in rules promulgated in accordance with chapter 1-26 , adopt a code of professional ethics for pharmacists in this state. The board shall consider the recommendations of the South Dakota Pharmacists Association in adopting the code or changes made thereto. The code may not contain any provision that would in any way restrain, prohibit, or attempt to regulate the rights of any pharmacist employed in a licensed pharmacy. Violation of the code of professional ethics may not be the basis for criminal prosecution unless otherwise declared unlawful.
